By accessing and using the Xeend platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use our platform.
2. Use of Service
Xeend provides a platform connecting customers with local restaurants, stores, and delivery riders. You agree to use our service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials.
3. User Accounts
You must create an account to use certain features of our service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for all activities that occur under your account.
4. Orders and Payments
All orders placed through the Xeend platform are subject to acceptance by the vendor. Prices are as listed on the platform at the time of order. Payment must be completed before delivery is initiated. We accept various payment methods as indicated in the app.
5. Delivery Services
Xeend facilitates delivery services through independent riders. Estimated delivery times are approximate and may vary due to factors beyond our control. We are not liable for delays caused by traffic, weather, or vendor preparation times.
6. Cancellations and Refunds
Order cancellations must be made before the vendor begins preparing your order. Refunds are issued at our discretion and typically processed within 5-7 business days. Contact our support team for refund requests.
7. Vendor and Rider Terms
Vendors and riders using our platform must comply with additional terms specific to their roles. This includes maintaining quality standards, timely service, and professional conduct. Commission rates and payment terms are outlined in separate vendor and rider agreements.
8. Prohibited Activities
You may not: (a) use the service for illegal purposes; (b) attempt to gain unauthorized access to our systems; (c) harass or harm other users; (d) provide false information; (e) violate any applicable laws or regulations.
9. Intellectual Property
All content, trademarks, logos, and intellectual property on the Xeend platform are owned by Xeend or our licensors. You may not use, copy, or distribute any content without our express written permission.
10. Limitation of Liability
Xeend is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our total liability shall not exceed the amount paid by you in the past 12 months.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of the service after changes constitutes acceptance of the modified terms.
